DMCA Policy for Harry Potter Series Release

Harry Potter Series Release ("we", "us", or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond promptly to claims of copyright infringement committed using the Harry Potter Series Release service and/or website (the "Service") if such claims are reported to our Designated Copyright Agent identified below.

This DMCA Policy outlines the procedures for filing a copyright infringement notice and a counter-notification regarding material hosted on Harry Potter Series Release services.

Filing a Notice of Copyright Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Harry Potter Series Release Service by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.

  1. Identification of the copyrighted work claimed to have been infringed: This should include a detailed description of the Harry Potter content (e.g., specific text, images, fan-fiction chapters, artwork) that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the material that is claimed to be infringing: Provide reasonably sufficient information to permit us to locate the material. This must include the specific URL(s) where the infringing Harry Potter material is located on the Harry Potter Series Release website or service.
  3. Your contact information: Provide your name, mailing address, telephone number, and, if available, an email address.
  4. A statement that you have a good faith belief: State that the use of the Harry Potter material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate: State that, under penalty of perjury, you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature: Provide the signature of the copyright owner or a person authorized to act on their behalf.

Filing a Counter-Notification

If you believe that your Harry Potter Series Release material has been removed or disabled by mistake or misidentification, you may file a counter-notification with us by submitting a written notification to our Designated Copyright Agent that includes substantially the following:

  • Identification of the material that has been removed or to which access has been disabled: This should include the specific URL(s) at which the Harry Potter material appeared before it was removed or access disabled.
  • A statement under penalty of perjury: State that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your contact information: Provide your name, address, and telephone number.
  • A statement of consent to jurisdiction: State that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, for any judicial district in which Harry Potter Series Release may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA infringement notice. If the complaining party does not file an action seeking a court order against the content provider, member, or user within 10-14 business days of receiving the counter-notification, the removed material may be replaced, or access to it restored, at our sole discretion.
